1. Who these terms are between
These terms apply between you, the person or organisation booking the service, and DJ Mishoo, operating in Calgary, Alberta. They cover DJ performance, MC services, and any sound, lighting or effects supplied as part of a booking.
Booking a date, paying a deposit, or confirming a package in writing means you accept these terms.
2. Bookings and confirmation
An enquiry is not a booking. A date is only held once a deposit has been received and written confirmation has been sent to you. Until then the date stays available to other clients.
Written confirmation will set out the event date, arrival and finish times, the venue, the package booked, and the total fee.
Prices shown on this site are starting prices. The final fee depends on the venue, the hours, travel, and any extras, and is confirmed in writing before a deposit is requested.
3. Deposits and payment
- A deposit of half the package price is required to hold a date.
- The deposit is non-refundable, because holding your date means turning down other work for it.
- The remaining balance is due on the day of the event, before the performance begins, unless agreed otherwise in writing.
- Travel outside Calgary, extra hours, and late finishes are quoted separately and added to the balance.
4. Cancellation and rescheduling
If you cancel
- The deposit is not refunded, whenever the cancellation happens.
- Cancelling 30 days or less before the event means the full balance remains payable, as the date can rarely be rebooked at short notice.
- One reschedule to a new date within 12 months is offered at no extra charge, subject to availability. If the new date is unavailable, the original booking is treated as a cancellation.
If I cancel
In the unlikely event of cancellation for a reason within my control, all money paid, including the deposit, is refunded in full. Reasonable efforts will also be made to find a suitable replacement DJ, though no particular replacement can be guaranteed.
5. Illness, emergencies and events outside anyone's control
Neither party is responsible for failing to perform because of something genuinely outside its control, including serious illness, extreme weather, road closures, power failure, venue closure, or government restriction.
Where this happens, the first step is to reschedule. If rescheduling is not possible, fees for services not delivered are refunded, less any costs already unavoidably incurred.
6. The venue, access and power
You, or your venue, are responsible for providing:
- Access for setup at the agreed time, usually 60 to 90 minutes before the performance.
- Safe, adequate mains power near the performance area.
- A level, dry, covered performance space of a size agreed in advance.
- Parking or loading access reasonably close to the entrance.
- Any permissions, licences or noise approvals the venue requires.
If access is delayed, or power or space is not as agreed, the performance may start late or be shortened. The full fee still applies in those circumstances.
7. Special effects
Dry ice and cold spark fountains are offered with some packages. Both need your venue's written approval in advance, and some venues do not permit them or require a fire safety plan.
Where a venue refuses approval, those effects will not be used. This is not a failure to deliver the booking, and no refund is due for the effects element. Please check with your venue early.
8. Equipment and damage
All equipment remains the property of DJ Mishoo. You are responsible for damage to it caused by you, your guests, or others attending your event, other than fair wear and tear or damage caused by me.
For everyone's safety, guests may not operate the equipment. Drinks are not permitted on or near the DJ booth.
9. Conduct and safety
I reserve the right to stop the performance and leave, with the full fee remaining payable, if there is a genuine threat to the safety of people or equipment, including violence, threatening behaviour, or sustained abuse toward me or my equipment.
This is a last resort. In practice a quiet word with you comes first.
10. Music, requests and volume
Your must-play and do-not-play lists are agreed in advance and will be respected. Beyond those, song selection and mixing on the night are at my discretion, based on reading the room.
Volume will be kept within any limit set by the venue, including automatic sound limiters. Where a limiter or venue policy restricts volume, that is not a failure to deliver the booking.
11. Photos and video
Photos or video may be taken of the setup and the event for use in promotion, including on this website and on social media. Tell me in writing before the event if you would prefer this not to happen, and it will not.
12. Reviews
Reviews submitted through this site are sent to me and are only published with your consent, given on the review form. Reviews are published with a first name and event type. Publication, editing for length, and removal remain at my discretion.
13. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud, or for anything else that cannot be limited by law.
Subject to that, total liability in connection with a booking is limited to the total fee paid for that booking. I am not liable for indirect or consequential loss, such as lost profits or the cost of other parts of your event.
14. Privacy
Information you send through this site is handled as described in the privacy policy.
15. Changes to these terms
These terms may be updated from time to time. The version that applies to your booking is the version published on the date your booking was confirmed in writing.
16. Governing law
These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. The courts of Alberta have jurisdiction over any dispute.
